TEXT OF AFFIDAVIT:

DEPOSITION

Case of Mary A. Berkley, No. 314,721

On this 11th day of March, 1890 at San Francisco, County of San Francisco,
State of California, before me, EGHursh, a Special Examiner of the
Pension Office, personally appeared:

Anna McAuliffe, who, being by me first duly sworn to answer truly all
interrogatories propounded to her during this Special Examination of
aforesaid pension claim, deposes and says:

my name is Anna McAuliffe aged 47 years, occupation houseKeeper for
my family, P.O. Address 1707 Sacremento St., San Francisco, California.

I have known claimant all her life time, she is my sister.
I became acquainted with Joseph M Berkley her late husband in 1874
after they came to San Francisco, Cal.  He was in poor health when
he came here.  I was informed that he was sickly while in
Washington DC and I sent them money to come out here. I paid their
full fare from Washington DC out here.  He had a hacking cough when
he came here, and had to lay off work occasionally with bad sick spells.
He seemed to raise in turns a good deal from his lungs.  He would work
now and then but never steady.  He always had a distressing feeling in
his chest when he got bad.  I judged from the way he breathed that he
was distressed about his chest.  He breathed so hard that I often
thought he would choke.  I have been there when I thought he would
choke before I would get out the house.  At first he had a bad cough
and bad spells from that, and then he kept growing worse and he seemed
[...] to leave a kind of rattling voice proceed from him the [...] as
my brother had who died from consumption at the Sisters hospital in
Washington DC.

When he first came here he and his family lived in the same house
with me and know that he never was well thing he was a yellow, sallow
looking man when I first saw him.  My two brothers who are now dead,
Thomas and Andrew Wheeler, told me that they both objected to the
marriage of my sister the claimant with Joseph M Berkley on account
of his sickly conditiona dn poor health but that she would marry him
anyway.  He was always an incumbrance on me before he died on account
of his poor health.

I don't remember now whether he ever complained of pains in his heart
or not, he may have but I don't remember it now.  I know he used to
complain of severe pains about the chest.  He also told me he got [...]
struck while in the Army.  He was a broken down man generally unfit
for general labor, he would work occutionally and then he couldn't
work for quite awhile.  He used to be taking medicine all the time.
I remember Dr. Kain used to prescribe for him.  Dr. Kain is now dead.
Come to think I am not positive whether it was Doctor Kain or some
other doctor I am pretty sure but not real positive.

Joseph Mortimer Berkley died in April 1880 can't state the date.
Little Margaret was only about six weeks old when he died.

I do not know whether he ever was married before he married my
sister [....] or not.
